Terms of Service

These Terms of Service (“Terms”) are a contract between you and the operator of Pumo (“Pumo,” “we,” “us”), a natural person established in Greece. They apply to the marketing site at pumo.app and www.pumo.app, the product at studio.pumo.app, and related applications and APIs (the “Services”).

By creating an account, starting a listing check, buying a plan, or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

If you use the Services on behalf of a business, you represent that you have authority to bind that business, and “you” includes that business.

1. The Services

Pumo is a creative performance product for marketplace sellers. Depending on your plan, the Services may include listing checkup and visual gap analysis; competitor comparison and Competitor Radar; brand and product context you provide or we extract; AI-assisted product photography, listing images, and listing video; and an asset library, account, and billing.

We may add, change, or withdraw features. Features marked beta or preview are provided as-is.

Pumo is not affiliated with, endorsed by, or a partner of Amazon, Etsy, Shopify, or any other marketplace. Marketplace names are used only to describe compatibility.

2. Eligibility and accounts

The Services are for business use. You must be at least 18 and able to form a contract.

You must provide accurate account information and keep it current. You may sign in with email and password or a supported third-party login (currently Google). You are responsible for activity under your account and for keeping credentials confidential. Tell us promptly at hello@pumo.app if you believe your account has been misused.

We may refuse, suspend, or close an account if information is false, if these Terms are broken, or if we reasonably believe we need to protect Pumo, other users, or third parties.

3. Marketplace listings and competitor data

You may paste a listing URL or ASIN, connect a shop, or otherwise identify products as yours. You represent that you own those listings or are authorized to analyze and improve them.

To provide checkup, competitor sets, Radar, and related features, we retrieve public marketplace information about listings you identify and about other listings that appear to compete for the same shopper. That may include titles, images, prices, reviews, search placement, and similar publicly visible fields. We use third-party data providers to collect this information. You authorize us to collect, store, compare, and display that information inside the Services for your internal business use.

You may not use competitor listing content we show you as if it were your own creative. Analysis inside Pumo is not a license to copy another seller’s assets, trademarks, or packaging.

Marketplace data can be incomplete, delayed, or wrong. Rank, conversion, and related insights are estimates, not statements of fact about a marketplace’s systems.

4. Your content

“Customer Content” means everything you submit or connect: product photos, logos, fonts, brand colors, listing URLs, ASINs, copy, prompts, comments, and similar materials.

You retain whatever rights you already have in Customer Content. You grant Pumo a worldwide, non-exclusive license to host, store, reproduce, modify, and display Customer Content, and to send it to subprocessors, only as needed to operate, secure, support, and improve the Services (including generating assets and running checkup and Radar). This license ends when Customer Content is deleted from our systems, except for residual copies in backups or logs, or as we must keep for legal or security reasons.

You represent that you have the rights to submit Customer Content and that it does not infringe others’ IP, privacy, or publicity rights, and does not contain illegal material. Do not upload government ID numbers, payment card numbers, or other sensitive personal data about people who are not using the account.

We do not claim ownership of Customer Content.

5. Generated assets

“Outputs” are images, video, copy suggestions, briefs, scores, and other materials the Services produce for you.

As between you and Pumo, you own the Outputs created for your account, to the extent the law allows us to assign those rights. You may use them commercially on your listings, ads, site, and social channels.

That ownership is subject to: your compliance with these Terms; third-party rights in Customer Content you provided; our software, actor and scene catalog, and UI, which stay ours; the fact that AI Outputs may not be unique; and the fact that copyright in AI-generated works is treated differently by country. We grant you all rights we can; we do not promise that every Output is copyrightable.

You must review Outputs before you publish them. Labels, claims, proportions, and marketplace-rule checks are assists, not a guarantee that a marketplace will accept the asset or that it is accurate.

We do not use Customer Content or Outputs to train our own machine-learning models. Generation is performed by third-party AI providers. Where a provider lets us opt out of training, we will. We cannot control every provider’s independent practices; their terms also apply to the processing they perform to return an Output.

6. Catalog actors, scenes, and templates

Pumo may provide catalog actors, scenes, and similar presets for generated video or imagery. We grant you a limited license to use Outputs that include those presets in the generated asset, for your product marketing.

You may not extract catalog actor images or likenesses for other uses, present a catalog actor as a real customer or endorser, or use the catalog to build your own actor library.

7. Acceptable use

You may use the Services only for lawful business purposes and in line with marketplace and advertising rules that apply to you.

You may not: reverse engineer, scrape, or overload the Services, or access them by automated means except through an API we expressly provide; resell or white-label the Services without our written consent; upload malware, or try to access other users’ accounts or our systems; generate or upload illegal content or content that exploits minors; use the Services to infringe IP, including other sellers’ listing images; use Customer Content or Outputs to train competing AI models; or misrepresent Pumo results as an official Amazon or Etsy score, audit, or partnership.

We may remove content or suspend access if we reasonably believe this section is violated.

8. Plans, trials, and payment

Paid plans, product allowances, Radar coverage, and prices are shown on pumo.app/pricing or in checkout at the time you subscribe. We may change prices for later billing periods; we will post the change or notify you in advance as required by law.

Trials require a payment method and convert to a paid subscription at the end of the trial unless cancelled before then. The public listing check can be used without a card. If you cancel before the trial ends, you will not be charged for that plan. After the trial, your payment method is charged on a recurring monthly cycle.

Subscriptions renew automatically until you cancel. You can cancel at any time. Access continues until the end of the then-current billing period. Unused monthly credits roll over up to twice your plan allowance; owned listing limits are fixed per plan.

Except where the trial terms above apply, or where applicable law requires otherwise, fees are non-refundable, including for unused days or unused product allowance. Failed generations that we do not deliver are not counted against your allowance.

Payments are processed by Stripe. You authorize us and Stripe to charge the payment method on file. You are responsible for taxes that apply. If a charge fails, we may retry and may suspend paid features until payment succeeds.

9. Third-party services

The Services depend on third parties, including hosting, auth, payments, analytics, email, marketplace data providers, and AI model providers. Those parties have their own terms. We are not responsible for outages, policy changes, or data handling by a third party beyond what we contract them to do for us.

If you connect Google or another login provider, you also agree to that provider’s terms for the login.

10. Our intellectual property

Pumo, the Services, our software, scoring methods, copy, design, and trademarks are owned by us or our licensors. These Terms do not sell you that IP. You may not copy our UI, scoring methodology, or marketing materials except as needed to use the Services.

If you send feedback, we may use it without obligation to you.

11. Disclaimers

The Services and Outputs are provided as is and as available. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that checkup scores, Radar alerts, or competitor sets are complete or error-free; that using Pumo will increase sales, conversion, rank, or ad performance; that Outputs will be accepted by a marketplace; or that the Services will be uninterrupted or secure.

You remain responsible for your listings, claims you make about your products, and compliance with marketplace, advertising, consumer, and product-safety law.

12. Limitation of liability

To the fullest extent permitted by law, Pumo will not be liable for lost profits, lost sales, lost data, marketplace suspension, or any indirect, incidental, special, or consequential damages.

Our total liability for all claims relating to the Services in any twelve-month period is limited to the greater of (a) the amounts you paid us for the Services in that period and (b) EUR 100.

These limits do not apply to liability that cannot be limited under applicable law, including fraud, or death or personal injury caused by negligence where that rule applies.

13. Indemnity

You will defend and indemnify Pumo against claims, damages, and reasonable costs arising from: Customer Content; your listings or advertising; your use of Outputs; your use of competitor or marketplace data we show you; or your breach of these Terms or of law.

14. Term and termination

These Terms last until you or we end them. You may stop using the Services and close your account by contacting hello@pumo.app or using in-product account controls when available.

We may suspend or terminate access immediately if you materially breach these Terms, if payment fails, or if we reasonably believe continued access would create legal, security, or marketplace-policy risk.

After termination, your license to use the Services ends. You keep rights in Customer Content and Outputs already downloaded, subject to these Terms and third-party rights. We may delete remaining account data after a reasonable period, except where we must retain it.

Sections that by nature should survive (including 4–7 and 10–18) survive termination.

15. Changes

We may update these Terms. We will post the new version on this page and update the effective date. If a change is material, we will also give reasonable notice (for example by email or in-product notice). Continued use after the effective date is acceptance of the updated Terms. If you do not agree, you must stop using the Services and cancel.

16. General

These Terms are the entire agreement for the Services and replace prior terms for the same subject. If a provision is unenforceable, the rest remains in effect. You may not assign these Terms without our consent; we may assign them in a merger, acquisition, or sale of assets. Failure to enforce a provision is not a waiver.

These Terms are governed by the laws of Greece, excluding conflict-of-law rules. The courts of Greece have exclusive jurisdiction, except that we may seek injunctive relief in any court of competent jurisdiction.

The Services are intended for businesses. If mandatory consumer-protection law applies to you, it prevails over conflicting parts of these Terms.

We are not liable for delays caused by events beyond our reasonable control.
